FlowSign's Services are designed to facilitate the creation, transmission, signature, and storage of electronic records and electronic signatures, and the records and signatures generated through the Services are intended to satisfy the requirements of the U.S. Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) ("ESIGN Act"), the Uniform Electronic Transactions Act as adopted in U.S. state jurisdictions ("UETA"), and, to the extent applicable, Regulation (EU) No 910/2014 on electronic identification and trust services ("eIDAS"). However, the legal effect, validity, enforceability, and admissibility of any document or signature depends on the laws of the relevant jurisdiction, the nature of the transaction (some types of documents, including wills, trusts, certain real-estate instruments, court filings, and notarial acts, may be excluded from electronic execution in some jurisdictions), the parties' intent and consent, and the manner in which the Services are used. Industry-Specific and Regulatory Compliance
You are responsible for using the Services in compliance with all laws and regulations applicable to your industry, including, where applicable, the Health Insurance Portability and Accountability Act ("HIPAA"), the Gramm-Leach-Bliley Act, the Family Educational Rights and Privacy Act, state insurance and consumer-protection laws, and applicable foreign data-protection laws.
